Shift Up Corporation (hereafter, "Shift Up") has prepared these guidelines so that our creators can comfortably enjoy creating Secondary Creative Work (as defined below). Shift Up respects your Secondary Creative Activities (as defined below), which add a variety of fun and pleasure to our games and IPs. We believe Secondary Creative Activities implemented with your passion, creativity, and done with due consideration will have a positive influence on the development of our game content. Together with the creators like you, we will contribute to the revitalization of free Secondary Creative Activities and the development of cultural content.
If you use Game IPs (as defined below) for Secondary Creative Activities, you must abide by the following guidelines (hereafter, the “Guideline”).

1. Definition

1) “Game IPs” refer to all intellectual property rights in and to the Original Works, all of which are owned or controlled by Shift Up.
2) "Original Works" refer to the content incorporated in the games developed or published by Shift Up, such as the game's worldview, story, and characters, as well as monster illustrations, background images, background music, and videos.
3) "Secondary Creative Work" refers to a new expression created by using the Game IPs or adding your own creativity to an Original Work. Examples of Secondary Creative Work include game-related merchandizes, videos, cartoons, novels, fan fiction, fan art, cosplay costumes, or cosplay photos and videos.
4) “Secondary Creative Activity” refers to the creative activity that creates a Secondary Creative Work. However, please note that merely copying the original work as-is (tracing or acts equivalent) cannot be considered a secondary creative activity. (Edited on August 5, 2023)
<Examples of acts that cannot be called secondary creative activities>
- The act of copying exact illustrations of the official game characters whose exclusive copyrights belong to Shift Up with no meaningful adaption or creative addition and pasting them on goods such as acrylic stands and stickers, or the act of adding simple adaptations such as transformations or color changes

2. Scope of Use of Secondary Creative Work

1) Commercial use of Secondary Creative Works is prohibited. However, advertising or sponsorship revenue from the Secondary Creative Works posted on content platforms such as YouTube and Twitch are allowed, provided that Shift Up, in our sole discretion, may request that such revenue functions be turned off.
2) Exchange of Secondary Creative Works are allowed if they fall under the activities of the creators' hobby (such as fan art from an artist), including exchange with monetary consideration.
3) Figures and “garage kits” based on Original Works may be sold at events where their copyrights are granted to the Secondary Creative Works on the same day as the sale. Participation in a figure event with the ""same-day copyright system"" can be permitted through screening. Please contact each event organizer to apply for copyrights on the day of the event. Aside from events, individuals or organizations who sell figures and garage kits online are only permitted if they do not fall within the restrictions in the fourth clause (Compliance with law and non-infringement). 4) If you are a corporate body, business entity, an individual out of the allowable scope of Secondary Creative Activities, or a non-corporate commercial body, please inquire for more details. (:: S H I F T U P ::)

3. Prohibited Use

1) You may not sell, disclose, or distribute any Secondary Creative Work for any purposes beyond fan activity.
2) You may not submit any Secondary Creative Work to contests or public events without our express permission.
3) You may not utilize the game's intellectual property for the creation, distribution, and offering of game services. (Revised on March 26, 2024)

4. Compliance with law and non-infringement

1) We do not provide any warranty to you by this Guideline. If you want to perform Secondary Creative Activities using copyrighted works whose exclusive right does not belong to Shift Up, you must obtain a license from the right owner of said content.
2) When creating a Secondary Creative Work, you shall not:
- violate laws or violates the rights of others, such as intellectual property and portrait rights.
- express a specific political opinion or position
- discriminate, degrade, or promote provocation and hatred against religion, race, gender, or a specific group
- use contents that may make Original Work be misunderstood
- produce or distribute Secondary Creative Works with content that can be mistaken for official Shift Up content, or falsely state, suggest, or otherwise misrepresent, explicitly or implicitly, that you are sponsored by, endorsed by, or affiliated with, Shift Up or any related parties
- perform any other activity that Shift Up considers inappropriate

5. When you disclose Secondary Creative Works, please clearly specify their original source (Shift Up and the game name).

6. If you breach this Guideline or any related terms, Shift Up may take measures that we deem appropriate, including, but not limited to, requesting you cease your publication, distribution, or transmission of, or delete the Secondary Creative Works.

7. Any rights to the Game IPs are reserved by Shift Up or its licensors.

8. This Guideline is subject to change without prior notice, and separate policies may apply to the guidelines according to individual matters.
